Terms of Service

MachineKeep ("the Service") is a fleet maintenance and asset management platform operated in South Australia, Australia ("we", "us", "our").

MachineKeep provides software tools for recording and tracking machine servicing, repairs, pre-start checklists, and parts for customer-managed fleets and/or your own internal fleet. We provide software only — we are not responsible for any maintenance decisions made based on data stored in the app.

• You must be 18 years or older to create an account.
• You are responsible for maintaining the security of your login credentials and for all activity under your account.
• You must provide accurate information when creating your account and keep it up to date.

• Your workspace may receive a 7-day free trial with full access to all features without providing payment details. The trial period is determined in the product and shown in the app.
• After the trial ends, continued access requires completing subscription checkout (Stripe), which collects payment details and begins paid service at the advertised rate.
• Subscriptions are billed monthly and renew automatically until cancelled.
• You may cancel at any time. Cancellation takes effect at the end of your current billing period. No refunds are provided for partial months.
• Pricing may change with at least 30 days notice to your registered email address.

You own all data you enter into MachineKeep. We will not sell, share, or use your data for any purpose other than providing the Service.

If you cancel, your data is retained for 30 days so you can export it. After that period, all your data will be permanently deleted.

You agree not to:

• Use the Service for any unlawful purpose
• Attempt to gain unauthorised access to any part of the Service
• Reproduce, sell, resell, or exploit the Service without our written permission
• Upload content that infringes any third party's rights
• Use the Service to transmit spam or malicious content

We reserve the right to suspend or terminate accounts that violate these terms.

We aim to keep MachineKeep available at all times but do not guarantee uninterrupted access. Scheduled maintenance, updates, or events outside our control may occasionally affect availability.

We are not liable for any losses caused by downtime, data loss, or service interruptions.

MachineKeep, its design, code, and content are owned by us. You may not copy, modify, or distribute any part of the Service without our written consent.

You retain all rights to the data you enter. By using the Service, you grant us a limited licence to store and process that data solely to provide the Service to you.

To the maximum extent permitted by Australian law, MachineKeep is provided "as is" without warranty of any kind. We are not liable for any indirect, incidental, special, or consequential damages arising from your use of the Service.

Our total liability to you shall not exceed the total amount you paid us in the 3 months prior to the claim.

These terms are governed by the laws of South Australia, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of South Australia.

We may update these terms from time to time. We will notify you by email at least 14 days before any material changes take effect. Continued use of the Service after that date constitutes acceptance of the updated terms.
